Boehringer Ingelheim, represented by NLP, prevailed before the UPC Court of Appeal in Luxembourg.
On 13 August 2025, the Court of Appeal of the Unified Patent Court granted a preliminary injunction against Zentiva, overturning the Lisbon Local Division’s earlier decision. In this landmark ruling, the Court of Appeal addressed, for the first time, the issue of imminence of infringement of a pharmaceutical patent in the context of preliminary injunction proceedings.
The case was argued by Joana Piriquito Santos, Sara Nazaré and Beatriz Lima, assisted by João Assunção.
